Escape Room Waiver and Release of Liability

PLEASE READ CAREFULLY BEFORE SIGNING. THIS IS A LEGALLY BINDING DOCUMENT.

I acknowledge that I have voluntarily chosen to participate in the escape room experience provided by GAME OVER CLEARWATER LLC. I understand that participating in the escape room involves physical and mental challenges, including but not limited to solving puzzles, riddles, and potentially encountering simulated or special effects.

In consideration for being allowed to participate in the escape room experience, I agree to the following terms and conditions:

1. Assumption of Risks: I understand that participating in the escape room experience may involve certain risks and hazards, including but not limited to physical exertion, slipping, tripping, falling, collisions with objects or other participants, and other unforeseen dangers. I voluntarily assume all such risks and hazards associated with the escape room experience.

2. Health and Safety: I certify that I am physically and mentally fit to participate in the escape room experience. I acknowledge that if I have any pre-existing medical conditions, such as heart conditions, epilepsy, asthma, or any other condition that may be affected by physical exertion, it is my responsibility to consult with a medical professional and determine whether it is safe for me to participate. I will immediately inform the staff of GAME OVER CLEARWATER LLC if I feel unwell or believe that my health or safety is at risk during the escape room experience.

3. Release of Liability: I hereby release, waive, discharge, and covenant not to sue GAME OVER CLEARWATER LLC, its owners, employees, agents, and representatives, from any and all liability, claims, demands, actions, or causes of action arising out of any loss, damage, or injury, including death, that may be sustained by me or any property belonging to me, whether caused by the negligence of GAME OVER CLEARWATER LLC or otherwise, while participating in the escape room experience.

4. Indemnification: I agree to indemnify and hold harmless GAME OVER CLEARWATER LLC, its owners, employees, agents, and representatives from any liability, damage, or expense, including reasonable attorney's fees and costs, arising out of my participation in the escape room experience.

5. Photography and Videography: I grant GAME OVER CLEARWATER LLC the irrevocable right and permission to use photographs and/or videos taken of me during the escape room experience for promotional and marketing purposes without compensation or further notice.

6. Governing Law and Severability: This Waiver and Release of Liability shall be governed by and construed in accordance with the laws of Clearwater, FL. If any provision or portion of this waiver is determined to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

By signing below, I acknowledge that I have read, understand, and voluntarily agree to the terms and conditions outlined in this Escape Room Waiver and Release of Liability.
